IRCC states that spouses or common-law partners of some international students may be eligible, not all. Starting January 21 2025, the student route includes a master’s degree program of 16 months or longer or a doctoral degree program, subject to the complete current criteria. Do not use “postgraduate” as a substitute for the formal credential type.

Check the official LOA, program duration and credential awarded. A graduate certificate, postgraduate diploma or shorter master’s may not fit the same rule. If the institution changes the duration or grants advanced standing, confirm how IRCC treats the actual program rather than relying on the marketing length.

The principal student needs a valid study permit for the route described by IRCC. Application timing matters when the student is still outside Canada, waiting for approval, already studying or in the final term. Build the family file around the live IRCC instructions for that situation.

Build consistent marriage or common-law evidence

A qualifying program does not remove the need to prove a genuine eligible relationship.

For a married couple, use the legal marriage certificate and certified translations where required. Make names, dates and addresses consistent across passports, forms and supporting records. If a Nepali document uses a different spelling or calendar format, explain it rather than silently changing information.

Common-law status has a specific immigration meaning and generally requires evidence of the required period of cohabitation. Photos or messages alone may not prove it. Use the current document checklist and provide reliable records such as joint residence, financial arrangements and official correspondence where applicable.

Both partners should understand the application. Avoid copied relationship narratives or contradictory travel and residence histories. A representative should not invent evidence or retain control of the couple’s account. False documents or material misrepresentation can have serious consequences.

Connect the spouse application to the student evidence

The family application should show the qualifying study situation and a credible practical plan.

Include the student’s LOA, study permit where applicable, enrolment evidence and program information requested by IRCC. If the applications are submitted together, follow the family-application instructions and link each person’s forms and fees correctly. If submitted separately, use the current proof requirements for the principal applicant.

Prepare a realistic family budget covering tuition, required study-permit funds, spouse travel, housing, insurance, childcare when relevant and an emergency reserve. An open work permit allows work within its conditions but does not guarantee a job or wage. Do not present expected employment as the only source of essential funds.

Check medical examination and biometrics requirements for each person. A spouse planning to work in healthcare, childcare or another protected setting may need appropriate medical results to avoid occupational restrictions. Follow IRCC instructions rather than booking tests based only on social-media advice.

Understand permit limits employment and extensions

An approval is the beginning of compliance, not a promise of work.

Read the issued work permit and its expiry date and restrictions. An open permit generally allows work for many employers, but IRCC lists excluded employers and possible occupational limits. The spouse should obtain a Social Insurance Number when eligible and follow provincial employment standards and tax rules.

The spouse’s permit validity may be tied to the principal student’s status. IRCC’s extension criteria include the student’s valid permit, physical presence and full-time enrolment in a PGWP-eligible program, among other requirements, and the spouse’s extension cannot exceed the student permit expiry described on the official page.

Changes such as withdrawal, part-time study, the final term, a DLI transfer or permit expiry can affect the family plan. Keep enrolment and status records, review expiry dates early and seek authorised advice before a gap occurs. Keep a dated evidence file before submission

A search result or counselling note can become outdated between shortlisting and application. Create one folder containing the official pages relied on, the date each page was checked, written answers from the institution, the final fee and refund terms, and the exact application files submitted.

When a policy changes, compare the new instruction with the student’s application date, credential, institution, campus and personal status before deciding what applies. Do not silently replace an old document or reinterpret a rule from a headline. If the effect is uncertain, pause payment or submission and obtain clarification from the responsible authority or a properly authorised professional.
