USA Tax Filing and Form 8843 Guide for Nepali F-1 Students 2026–2027
An official-source starting point for Nepali F-1 students separating immigration status from tax residency, organizing income forms, understanding Form 8843 and checking federal and state obligations.
Many F-1 students treated as nonresident aliens for tax purposes file Form 8843 to explain excluded days of U.S. presence. A student with taxable U.S. income may also need Form 1040-NR. The correct filing depends on tax residency, income, treaty and state facts—not simply the visa label.
Tax disclaimer: This educational guide is not individual tax advice. Forms, thresholds, deadlines and treaty treatment can change. Use the current IRS instructions and qualified help for the student’s actual tax year.
Do not confuse visa status with tax residency
F-1 is an immigration classification. “Resident alien” or “nonresident alien” for tax is determined under the Internal Revenue Code. IRS Publication 519 explains the substantial presence test and the rules for exempt individuals. In this context, “exempt” usually means certain days are not counted for that test; it does not automatically mean income is exempt from tax.
| Question | Primary source | Why it matters |
|---|---|---|
| What is the tax residency status? | IRS Publication 519 | Selects the return and many tax rules |
| Were days excluded as a student? | Form 8843 instructions | Explains the presence-test claim |
| Was U.S. income received? | W-2, 1042-S and other records | May trigger a federal return |
| Does a treaty provision apply? | IRS treaty resources | Can change income treatment |
| Is a state return required? | State revenue authority | State residency rules differ |
Understand the statement before copying answers
The IRS says Form 8843 is used by an alien individual to explain the basis for excluding days present in the United States from the substantial presence test as an exempt individual or because of a medical condition. F-1 students commonly complete the student section with visa, entry, school and presence information.
A qualifying nonresident student may need Form 8843 even without U.S. income. When a federal return is also required, the form is generally attached as instructed. When it is filed by itself, follow the current form instructions for the correct address and deadline.
Build the file before choosing a return
Collect every official income and withholding record. Common examples can include Form W-2 for wages, Form 1042-S for certain payments to foreign persons and Form 1099 in situations that need careful classification. A document arriving late does not mean it can be ignored.
| Record | Check | Action |
|---|---|---|
| Passport, visa and I-94 | Entry dates and status | Use for presence and identity history |
| Forms I-20 | Programme and DSO details | Keep all versions for the tax year |
| W-2 or 1042-S | Income and withholding | Reconcile employer or payer details |
| Scholarship or fellowship letter | Qualified and nonqualified components | Review under IRS and treaty rules |
| Prior returns and Forms 8843 | Consistency and carryover | Do not repeat an old answer blindly |
Use the form that matches the tax facts
A nonresident alien with a federal filing obligation may need Form 1040-NR. A student who becomes a resident alien for tax purposes may use a different return. The result can change after several calendar years or because of other presence, so reassess rather than assuming last year’s status continues.
An SSN is generally tied to authorized employment. A person not eligible for an SSN may request an ITIN only when there is a valid federal tax reason and the Form W-7 requirements are met. An ITIN does not authorize work or change immigration status.
Question withholding without guessing
Social Security and Medicare tax treatment for foreign students can depend on tax residency, immigration status, employment type and the student exception. If FICA appears to have been withheld incorrectly, first raise the issue with the employer and use the current IRS refund guidance if it is not resolved.
Do not claim a refund merely because another international student received one. Keep pay statements, employment authorization and school enrollment evidence, and ask a qualified adviser to review an uncertain case.
Check more than the federal return
State tax residence and filing rules do not necessarily follow the federal nonresident-alien analysis. A student who lived, studied or worked in one or more states may have separate returns. Use the official revenue-department site for each relevant state.
Confirm the filing deadline for the specific return, whether wages were subject to withholding and whether the form is being filed alone. Submit through an accepted method, keep delivery proof and retain a complete copy.

USA student tax and Form 8843 FAQs
Does an F-1 student with no U.S. income ever file Form 8843?
Often yes. A nonresident F-1 student who excludes days of presence as an exempt individual generally files Form 8843 even when no U.S. income tax return is required. Confirm the individual facts and current IRS instructions.
Is an F-1 student automatically a nonresident alien for tax forever?
No. Tax residency is determined under tax rules, including the substantial presence test and limited exempt-individual treatment. Immigration status and tax residency are different concepts.
What tax return may a nonresident F-1 student with U.S. income need?
Depending on the income and facts, Form 1040-NR may be required, often with Form 8843 and income documents such as Form W-2 or Form 1042-S.
Is an SSN required to file Form 8843?
Form 8843 has a field for a taxpayer identification number if one exists. Do not apply for an SSN without work eligibility; follow IRS instructions for any valid ITIN need.
Do federal and state tax rules match?
No. A student can have separate federal, state and sometimes local filing obligations. Check the rules for the state where the student lived or earned income.
Can MKS Education prepare or certify a U.S. tax return?
No. MKS Education provides study-planning information, not tax advice or return preparation. Use current IRS resources and a qualified international-student tax professional for an individual case.
